On November 15, 2022 the Official Mexican Standard NOM-236-SE-2021 Vehicles- Physical-mechanical conditions of vehicles with a gross vehicle weight not exceeding 3,857 kg (“NOM”) was cancelled as per publication in the Federal Official Gazette (“DOF” by its abbreviation in Spanish). [1] The issuance of the NOM was published in the DOF on May 03, 2022 [2] and would originally come into effect in the last week of October of this year. However, on October 28, 2022, through a publication in the DOF,  the entry into force of the NOM was postponed until December 1, 2022. [3]

The main purpose of the NOM was to determine the technical inspection criteria to rule the physical-mechanical conditions of vehicles with a gross vehicle weight not exceeding 3,857 kg, to circulate under safe conditions in the national territory.

Several actions of the General Assembly of the United Nations were considered for the creation of the NOM, such as the Resolution for the Improvement of Road Safety in the World. Likewise, Mexico’s adherence to the Stockholm Declaration was considered, which establishes the commitment to institutionalize a Vehicle Technical Inspection system to help reduce deaths from traffic accidents by at least 50% between 2020 and 2030.

Mexico’s subscription to the National Road Safety Strategy 2011-2020 was also taken into account to develop the NOM, which contemplates the action of developing and strengthening regulatory frameworks that allow the creation, operation, and sustainability of vehicle technical inspection centers.

The scope of application of  the NOM were vehicles with a gross vehicle weight of design not exceeding 3.857 kg, except for those weighing less than 400 kg and those specially designed for agricultural work or the construction and mining industry, as well as vehicles intended for use in mountainous terrain, old cars (registered), among others.

The general provisions of the NOM included, inter alia, the elements to be covered by roadworthiness testing, as well as the intervals at which vehicles would be subjected, as well as the classification of automobile defects into levels such as minor, serious, and very serious.

The Secretary of Economy argued that by cancelling the NOM, Mexican families’ income would be protected given that Mexican families use these types of cars as working tools. However, certain voices have been raised questioning the cancellation of the NOM, for having safety implications, according to representatives of organizations of theautomobile industry. [4]

El 15 de noviembre del presente año, se publicó en el Diario Oficial de la Federación la cancelación de la Norma Oficial Mexicana NOM-236-SE-2021 Vehículos automotores-Condiciones fisicomecánicas de los vehículos con peso bruto vehicular que no exceda 3,857 kg. (“NOM”). [1]. La cual había sido emitida mediante una publicación en el DOF el 03 de mayo del 2022 [2] y entraría en vigor originalmente en la última semana de octubre del presente. Sin embargo, el 28 de octubre del 2022 mediante una publicación en el DOF se había modificado la entrada en vigor al 01 de diciembre del 2022. [3]

La NOM tenía como objetivo establecer los criterios de inspección técnica para determinar las condiciones fisico-mecánicas de los vehículos con un peso bruto vehicular que no excediera los 3,857 kg, para circular bajo condiciones de seguridad en el territorio nacional.

Para la creación de esta se tomaron en cuenta varias actuaciones de la Asamblea General de la Organización de las Naciones Unidas, tales como la Resolución para el Mejoramiento de la Seguridad Vial en el Mundo. De igual forma, se consideró la adhesión de México a la Declaración de Estocolmo, en donde se establece el compromiso de institucionalizar un sistema de Inspección Técnica Vehicular con la finalidad de ayudar a reducir las muertes por accidentes de tráfico en al menos un 50% entre los años 2020 y 2030.

Asimismo, se atendió a la suscripción de México a la Estrategia Nacional de Seguridad Vial 2011-2020, en la cual se contempla la acción de desarrollar y fortalecer marcos normativos que permitan la creación, funcionamiento y sostenibilidad de centros de inspección técnica vehicular.

En el campo de aplicación de la NOM se contemplaban los vehículos con un peso bruto vehicular de diseño que no excediera los 3,857 kg, con excepción de aquellos cuyo peso fuera menor a 400 kg y aquellos que fueran diseñados especialmente para  labores agrícolas o para la industria de construcción y minería, así como los vehículos orientados para utilizarse en terrenos montañosos, autos antiguos (matriculados), entre otros.

Las disposiciones generales de la NOM entre otras cosas incluían los elementos que debía comprender la inspección técnica, así como los intervalos en los que los vehículos se someterían, además de la clasificación de los defectos de los automóviles en niveles como leves, graves y muy graves.

La Secretaría de Economía argumentó que la cancelación se debía a que la aplicación de la NOM podía afectar el ingreso de las familias mexicanas que utilizan sus vehículos como herramientas de trabajo. Sin embargo, se han alzado ciertas voces cuestionando la cancelación de la NOM, por tener implicaciones en la seguridad vehicular, de acuerdo con representantes de organizaciones de la industria.
